Please read these terms carefully before engaging Maghtech for custom web development, AI engineering, or digital agency services.
1. Acceptance of Terms
By accessing the website, services, or software solutions provided by Maghtech ('Agency', 'We', 'Us'), you ('Client', 'User') agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our digital services.
2. Scope of Digital Services
Maghtech provides web development, AI automation pipelines, e-commerce engineering, technical SEO, and 3D WebGL UI/UX design. Specific scope, deliverables, timelines, and milestones for individual engineering engagements shall be governed by formal Statements of Work (SOW) or custom project agreements executed between Maghtech and the Client.
3. Intellectual Property & Ownership
Upon full settlement of agreed project fees, all bespoke code, visual assets, custom UI design files, and tailored AI workflow scripts created specifically for the Client shall become the sole property of the Client. Maghtech retains ownership of pre-existing core frameworks, open-source utilities, proprietary algorithms, and general engineering methodologies used across agency engagements.
4. Client Responsibilities
The Client agrees to provide accurate project specifications, timely feedback, asset materials, and API access required for execution. Delays in asset submission or feedback approvals may extend project completion deadlines accordingly.
5. Payment Terms & Invoicing
Services are invoiced based on agreed project milestones, retainer schedules, or hourly rate cards as outlined in the Statement of Work. Deposits and initial milestone payments are non-refundable once engineering sprints have commenced.
6. Performance & Core Web Vitals SLA
Maghtech commits to delivering optimized web applications targeting high Core Web Vitals metrics and sub-second execution speed under standard cloud Edge hosting environments. Client modifications or unoptimized third-party plugins added after deployment are excluded from performance guarantees.
7. Limitation of Liability
In no event shall Maghtech, its directors, or its software engineers be liable for any indirect, consequential, special, or punitive damages arising from website downtime, third-party API outages, or hosting infrastructure disruptions beyond the Agency's direct control.
8. Governing Law & Dispute Resolution
These Terms of Use shall be governed by and construed in accordance with international commercial law and applicable local regulations. Any legal proceedings shall be resolved amicably through good-faith mediation prior to formal arbitration.
